Contractor Attendance Agreement

1. Parties

This Contractor Attendance Agreement is made between:

Home Watch North Devon ("the Service Provider")

and

The Client ("the Property Owner" or "Client")

for the purpose of providing contractor attendance and property access services.

2. Purpose

The Client appoints Home Watch North Devon to attend the property on their behalf to provide access for contractors, tradespeople, surveyors, delivery personnel, or other authorised service providers.

Home Watch North Devon acts solely as the Client's representative for access and attendance purposes.

3. Services Provided

Services may include:

Opening and securing the property
Meeting contractors on arrival
Providing access to authorised persons
Remaining on-site during attendance where agreed
Locking and securing the property after completion
Providing updates, photographs, and reports to the Client

Services are limited to those specifically agreed in advance.

4. Client Responsibilities

The Client agrees to:

Provide accurate contractor details.
Ensure contractors have been properly instructed.
Confirm the date and time of attendance.
Provide any necessary access information.
Maintain adequate insurance for the property.

The Client remains responsible for all agreements, instructions, payments, and contractual arrangements with contractors.

5. Contractor Responsibilities

Contractors remain fully responsible for:

Their own work
Health and safety compliance
Professional standards
Licences and certifications
Security of their equipment
Compliance with applicable laws and regulations

Home Watch North Devon does not employ, supervise, or manage contractors unless expressly agreed in writing.

6. Limitation of Service

Home Watch North Devon does not:

Inspect contractor qualifications
Verify professional competence
Approve quotations
Authorise additional works
Certify workmanship
Provide technical advice
Guarantee completion of works

Any observations made during attendance are provided for general information only and do not constitute professional advice or approval.

7. Delays and Missed Appointments

Home Watch North Devon shall not be liable for:

Contractor delays
Contractor cancellations
Missed appointments
Incomplete works
Failure of contractors to attend

Additional attendance charges may apply where appointments are rescheduled or extended beyond the agreed time.

8. Property Access

Home Watch North Devon will only provide access to contractors authorised by the Client.

Where identification is reasonably requested, contractors may be required to provide proof of identity before access is granted.

Home Watch North Devon reserves the right to refuse access where there are reasonable concerns regarding safety, security, or authorisation.

9. Liability

Home Watch North Devon will exercise reasonable care while attending the property.

However, we shall not be liable for:

Defective workmanship
Property damage caused by contractors
Contractor negligence
Contractor delays
Contractor misconduct
Additional costs incurred by the Client due to contractor actions
Indirect or consequential losses

To the fullest extent permitted by law, our liability shall be limited to the fee paid for the attendance service giving rise to the claim.

Nothing in this Agreement excludes liability that cannot legally be excluded under the laws of England and Wales.

10. Insurance

The Client remains responsible for ensuring that:

The property is adequately insured.
Contractors carry appropriate insurance.
Any required permissions or approvals have been obtained.

Home Watch North Devon's attendance service does not replace these obligations.

11. Fees

Attendance services will be charged according to the rates agreed with the Client.

Additional charges may apply for:

Extended attendance
Emergency attendance
Out-of-hours attendance
Multiple contractor visits
Waiting time exceeding the agreed attendance period

12. Cancellation

The Client may cancel scheduled attendance by providing reasonable notice.

Where attendance is cancelled at short notice, Home Watch North Devon reserves the right to charge for time already allocated.

13. Governing Law

This Agreement shall be governed by and interpreted in accordance with the laws of England and Wales.

Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.
