1. About Us
Home Watch North Devon ("we", "our", "us") provides property inspection, key holding, contractor attendance and holiday let support services throughout North Devon.
By engaging our services, you agree to these Terms and Conditions.
2. Services
Services may include:
Property inspections
Vacant property checks
Key holding
Contractor attendance and access management
Holiday let support
Emergency attendance (where available)
Property condition reporting
Services will be provided with reasonable care and skill.
3. Property Inspections
Property inspections are visual inspections only.
Inspections do not constitute:
Building surveys
Structural surveys
Electrical inspections
Plumbing inspections
Professional engineering assessments
Insurance inspections
We will report visible issues identified during our visit but cannot guarantee that all defects, faults, leaks, infestations, security concerns, or maintenance issues will be detected.
4. Key Holding
Where keys are entrusted to Home Watch North Devon:
Keys will be stored securely.
We will take reasonable precautions to protect keys from loss or theft.
We accept no liability for losses arising from circumstances beyond our reasonable control, including criminal acts by third parties.
Clients are responsible for ensuring that keys provided are suitable and functional.
5. Contractor Attendance
Where we attend properties to provide access for contractors, tradespeople or service providers:
We act solely as the client's representative for access purposes.
We do not supervise, manage, certify, inspect or guarantee the quality of any contractor's work.
Responsibility for selecting, instructing and paying contractors remains with the client.
Any concerns regarding workmanship must be addressed directly with the contractor.
6. Holiday Let Support
We may provide support services to holiday let owners including property access, inspections and attendance.
We do not accept responsibility for:
Guest behaviour
Guest damage
Booking management
Loss of rental income
Online platform issues
Third-party service providers
Unless specifically agreed in writing.
7. Emergency Call-Outs
Emergency attendance is provided on a reasonable endeavours basis.
We cannot guarantee attendance within a specific timeframe due to:
Weather conditions
Road conditions
Staff availability
Other operational circumstances
8. Client Responsibilities
Clients agree to:
Provide accurate contact details.
Provide accurate property information.
Inform us of alarms, security systems and access procedures.
Notify us of any known issues affecting the property.
Ensure the property is adequately insured.
9. Liability
We maintain appropriate business insurance.
To the fullest extent permitted by law:
Our liability is limited to the amount paid by the client for the service giving rise to the claim.
We are not liable for indirect, incidental or consequential losses.
We are not liable for losses resulting from events outside our reasonable control.
We are not liable for pre-existing defects or conditions at the property.
Nothing within these Terms excludes liability where exclusion is prohibited by law.
10. Force Majeure
We shall not be liable for delays or failure to perform services resulting from circumstances beyond our reasonable control, including but not limited to:
Severe weather
Flooding
Fire
Power outages
Transport disruption
Government restrictions
11. Fees and Payment
Fees are payable in accordance with the pricing agreed with the client.
Payment may be required:
In advance
On completion of services
By monthly subscription
Late payments may result in suspension of services.
12. Cancellation
Clients may cancel scheduled services by providing reasonable notice.
Where appointments are cancelled at short notice, we reserve the right to charge for time already allocated.
Any subscription services may be cancelled with 30 days' written notice unless otherwise agreed.
13. Privacy
Personal information will be handled in accordance with our Privacy Policy and applicable UK data protection legislation.
We will not sell client information to third parties.
14. Complaints
Any complaint should be submitted in writing as soon as reasonably possible.
We will investigate complaints fairly and aim to respond within 14 days.
15. Governing Law
These Terms and Conditions are governed by the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
